“A|LOUD”, “we”, “us” and “our” refer to ALOUD F.Z.C.
These Terms and Conditions govern the use of the Website and the purchase of products and services from A|LOUD.
By using the Website or placing an order, you confirm that you have read and accepted these Terms together with our Privacy Policy, Shipping and Delivery Policy, Returns and Refunds Policy and Order Cancellation Policy.
Nothing in these Terms limits any mandatory consumer rights available under applicable law.
2. Eligibility to Purchase
To place an order, you must have the legal capacity to enter into a binding contract.
If you are under the legal age of majority in your country, an order must be placed or authorised by a parent or legal guardian.
You must provide accurate, complete and current information when placing an order.
3. Product Categories
A|LOUD may offer the following product categories:
- Ready-to-Wear products;
- Made-to-Order products in standard sizes;
- Made-to-Measure and Custom products;
- Bespoke products;
- Pre-Loved, archive or sample products, where available.
The relevant product category, specifications, production time and available options will be displayed on the product page or confirmed directly with the customer.
The inclusion of a product category in these Terms does not guarantee that products within that category will always be available.
4. Product Information
We make reasonable efforts to present product descriptions, colours, materials, measurements and images accurately.
Colours and details may appear differently depending on the customer’s screen and device. Minor variations may also occur because of the artisanal or individually produced nature of A|LOUD garments.
Such minor variations are not considered defects where they do not materially affect the quality, appearance or agreed specifications of the product.
For Pre-Loved, archive or sample products, any known signs of wear or relevant condition details will be disclosed on the product page.
5. Made-to-Order, Made-to-Measure and Bespoke Products
Made-to-Order products are individually produced after an order is placed, using the standard size and options selected by the customer.
Made-to-Measure and Custom products are produced using measurements or individual specifications supplied or approved by the customer.
Bespoke products are developed specifically for the individual customer according to the agreed design, measurements, materials and specifications.
Production begins only after the required payment, measurements and design details have been confirmed.
The customer is responsible for checking that all measurements, selections and information supplied are accurate. A|LOUD is not responsible for fitting issues caused solely by inaccurate information provided by the customer.
Any requested changes after production has begun may be refused or may result in additional costs and production time. Any additional cost will be communicated for approval before the change is carried out.
6. Production Times
Estimated production or preparation times are displayed on the relevant product page or communicated directly to the customer.
Production times begin only after all required measurements, specifications, approvals and payments have been received.
Production time is separate from delivery time. Delivery estimates begin from the date the order is dispatched.
Production and delivery dates are estimates unless A|LOUD expressly confirms a specific date in writing.
7. Orders and Contract Formation
Placing an order constitutes an offer to purchase the selected products under these Terms.
After an order is submitted, the customer will receive an electronic acknowledgement. This acknowledgement confirms that the order has been received but does not necessarily mean that it has been accepted.
The order is accepted when A|LOUD sends an order confirmation or begins production, whichever occurs first.
We may refuse or cancel an order before acceptance where:
- the product or required material is unavailable;
- the information provided is incomplete or incorrect;
- an evident pricing or description error has occurred;
- payment cannot be authorised;
- fraud or unauthorised activity is reasonably suspected;
- fulfilling the order would violate applicable law.
If we cannot accept an order after payment has been collected, the relevant amount will be refunded to the original payment method.
8. Prices, Duties and Taxes
Prices are displayed in the currency selected on the Website or indicated at checkout.
The final price, shipping cost and applicable duties and taxes will be displayed before payment.
All applicable import duties and taxes for international orders are calculated and collected at checkout according to the destination country.
International orders are shipped DDP (Delivered Duty Paid). A|LOUD is responsible for settling the applicable import charges with the courier. No additional import duties, taxes or customs-clearance charges should be requested upon delivery.
Orders delivered within the UAE are not subject to import duties.
Pricing or tax errors may be corrected before an order is accepted. If an error is discovered after payment, the customer will be contacted and may choose whether to proceed with the corrected amount or receive a refund.
9. Payment
Available payment methods are displayed at checkout.
The customer confirms that they are authorised to use the selected payment method and that the payment information provided is correct.
Orders may be subject to security, validation and authorisation checks. A|LOUD may suspend or cancel an order where payment is refused or unauthorised activity is reasonably suspected.
10. Shipping and Delivery
Shipping options, costs and estimated delivery times are governed by our Shipping and Delivery Policy.
Delivery estimates begin after dispatch and do not include production or preparation time.
The customer is responsible for providing a complete and accurate delivery address, contact name and telephone number.
Risk of loss or damage passes to the customer when the order is delivered to the customer or a person designated by the customer, subject to applicable consumer law.
Failed delivery, refusal of delivery or incorrect address information may result in reasonable return-to-origin, storage or reshipping costs, as described in our Shipping and Delivery Policy.
11. Order Cancellations
Cancellation requests are governed by our Order Cancellation Policy.
Ready-to-Wear orders may be cancelled before dispatch.
Made-to-Order, Made-to-Measure, Custom and Bespoke orders may be subject to cancellation restrictions once production has begun.
Nothing in these Terms limits any mandatory right of cancellation or withdrawal applicable under local consumer law.
12. Returns and Refunds
Returns, exchanges and refunds are governed by our Returns and Refunds Policy.
Ready-to-Wear and non-personalised Made-to-Order products may be eligible for return, subject to the applicable policy and mandatory consumer rights.
Made-to-Measure, Custom and Bespoke products produced according to the customer’s measurements or individual specifications are generally not returnable or refundable once production has begun, except where the product is faulty, damaged, incorrectly supplied or otherwise non-conforming.
13. Promotions and Discount Codes
Promotions and discount codes may be subject to separate conditions, validity periods and eligibility requirements.
Unless expressly stated otherwise, promotions and discount codes cannot be combined, exchanged for cash or applied retrospectively.
We may withdraw a promotion in cases of error, misuse or fraud, without affecting orders already validly accepted.
14. Intellectual Property
All content available on the Website, including text, designs, garment designs, photographs, videos, graphics, logos and trademarks, belongs to ALOUD F.Z.C. or is used with permission.
Content may not be copied, reproduced, modified, distributed, commercially exploited or used to create derivative products without prior written permission.
15. Acceptable Use
You must not use the Website:
- for unlawful or fraudulent purposes;
- to interfere with its security or operation;
- to introduce viruses or harmful technology;
- to obtain unauthorised access to accounts, servers or data;
- to copy or extract Website content through automated systems without permission;
- to infringe the rights of A|LOUD or another person.
We may suspend access where we reasonably believe these Terms have been violated.
16. Marketing Communications
Using the Website or placing an order does not automatically subscribe the customer to marketing communications.
Marketing emails will be sent only where the customer has separately subscribed or where otherwise permitted by applicable law.
Customers may unsubscribe at any time by using the link included in the communication.
Transactional messages relating to an order, payment, production or delivery are not marketing communications.
17. Third-Party Services
The Website may contain links to or use services provided by third parties, including payment providers, couriers and social media platforms.
A|LOUD is not responsible for third-party websites or services that are outside our reasonable control. The use of those services may be governed by separate terms and privacy policies.
18. Website Availability and Errors
We do not guarantee that the Website will always be uninterrupted or free from technical errors.
We may update, suspend or withdraw parts of the Website for maintenance, security or operational reasons.
Nothing in this section affects accepted orders or mandatory consumer rights.
19. Liability
A|LOUD does not exclude or limit liability where doing so would be unlawful.
To the maximum extent permitted by law, A|LOUD is not responsible for indirect or unforeseeable losses arising from use of the Website or purchase of products.
Nothing in these Terms excludes liability for fraud, wilful misconduct, death or personal injury caused by negligence, or faulty or non-conforming products where such liability cannot legally be excluded.
For consumers, these Terms do not limit any remedy or protection provided by mandatory consumer law.
20. Events Outside Our Control
A|LOUD will not be responsible for delay or failure caused by circumstances outside our reasonable control, including natural disasters, severe weather, customs delays, transport disruption, government restrictions, labour disputes, epidemics or interruption of essential services.
We will make reasonable efforts to inform affected customers and minimise the delay.
This section does not remove any right to a refund or other remedy provided by mandatory law.
21. Governing Law and Jurisdiction
These Terms are governed by the laws of the United Arab Emirates.
The courts of Ajman, United Arab Emirates, will have jurisdiction, except where mandatory consumer law gives the customer the right to bring proceedings in another competent jurisdiction.
Consumers located outside the UAE retain any mandatory protections that cannot lawfully be excluded by a choice-of-law clause.
22. Changes to These Terms
We may update these Terms by publishing a revised version on the Website.
Changes will apply to future use of the Website and orders placed after the revised Terms become effective. An accepted order will remain governed by the version in effect when the order was placed, unless a change is required by law.
23. Severability
If any provision of these Terms is found to be invalid or unenforceable, it will be limited or removed only to the extent necessary. The remaining provisions will continue to apply.
